Terms of Service

1. Who we are and what this agreement covers

Dropzone Fishing is operated by Chad Roe, sole trader (ABN pending — to be added once registered) ("Dropzone Fishing", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Dropzone Fishing website and application (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to create an account. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf, and that any drone flown using information from this Service is operated in accordance with applicable law, including any age or supervision requirements imposed by the Civil Aviation Safety Authority (CASA) or other relevant aviation authority.

3. What the Service is — and is not

Dropzone Fishing is an informational planning and reference tool for recreational and hobbyist drone and land-based fishing. It provides estimated weather, tide, wind, seabed, and flight-safety information intended to help you plan a fishing session. Some information is sourced from third-party weather, tidal, and government seabed-survey data providers and may be incomplete, delayed, or inaccurate for your exact location. Some seabed and depth information is a mathematical estimate, not a surveyed measurement, and is labelled accordingly within the Service where possible.

The Service is not: a certified aviation safety system, a substitute for manufacturer flight manuals or ratings, a navigational chart for maritime use, a guarantee of drone flight safety, or a substitute for your own judgment, visual observation of conditions, and compliance with the law.

4. Drone flight risk — you are the pilot in command

Operating a drone carries inherent risks, including but not limited to loss of the aircraft, personal injury, property damage, and regulatory penalties. By using the Service, you acknowledge and agree that:

• You are solely responsible for the safe, lawful operation of any drone you fly, regardless of any information, forecast, or recommendation shown in the Service.
• You are solely responsible for knowing and complying with all applicable aviation law (including CASA rules in Australia), fisheries regulations, marine sanctuary boundaries, and local council or landowner restrictions before every flight.
• Wind, battery, payload, and flight-time estimates shown in the Service are approximations based on manufacturer specifications and simplified physics models. They are not a guarantee of your drone's actual performance on any given day, and do not account for every real-world factor (equipment condition, firmware, individual battery health, gusts, temperature, and more).
• You will not rely on the Service as your sole basis for a go/no-go flight decision, and will independently verify conditions before flying.
• Dropzone Fishing does not provide drone insurance, and maintaining any insurance appropriate to your drone operations is solely your responsibility.

As a general guide, recreational drone flying in Australia (CASR Part 101, "excluded category") currently requires that you: fly below 120 m (400 ft) AGL; fly only in daylight; keep your drone within visual line of sight at all times; stay clear of people, crowds, and emergency operations; and avoid controlled aerodromes, restricted airspace, and protected areas without approval. CASA can issue on-the-spot infringement notices of up to $1,650 per offence, and court-prosecuted breaches can attract penalties up to $16,500 per offence. If you fly for payment or commercial gain, different rules apply and you must hold the appropriate CASA licence (RePL) and operate under a Remote Operator Certificate (ReOC). This summary is general information only, is not exhaustive, may change, and is not a substitute for checking current requirements directly with CASA (including via the OpenSky app) before every flight.

5. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at dropzonefish@gmail.com if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

6. Subscriptions and billing

Certain features of the Service ("Premium" or similar) are offered on a paid subscription basis. Subscription pricing, billing frequency, and cancellation terms will be presented to you at the time of purchase. Subscriptions renew automatically unless cancelled before the renewal date. Subscription fees are non-refundable, including for partial billing periods. You can cancel anytime from within the app, and you'll keep Premium access until the end of your current paid period. This doesn't affect your rights under the Australian Consumer Law, including any consumer guarantee that can't be excluded by these Terms.

7. Your saved data

Fishing spots, catch logs, and session data you save are private to your account and are not shared publicly or with other users. See our Privacy Policy for details on how this information is stored and used.

8. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose, including flying a drone in violation of CASA rules, restricted airspace, or protected marine sanctuary zones;
• Upload, store, or transmit any photo or content that is illegal, exploitative, or depicts a minor in a sexual, abusive, or otherwise inappropriate context — this is strictly prohibited under any circumstances;
• Upload any photo or content that is obscene, violent, harassing, or that you do not have the right to share;
• Attempt to gain unauthorised access to other users' accounts or data;
• Interfere with, disrupt, reverse-engineer, or attempt to bypass any security or access-control feature of the Service;
• Use automated means to scrape or extract data from the Service without our written permission.

Zero tolerance for child exploitation material. We have a zero-tolerance policy toward any content depicting or relating to the sexual exploitation or abuse of children. Any account found uploading such material will be immediately and permanently terminated, the content preserved as evidence, and the matter reported to the eSafety Commissioner and/or Australian Federal Police, and to any other relevant law enforcement agency in the applicable jurisdiction, without prior notice to the account holder. We reserve the right to review uploaded content, including catch photos, to enforce this policy.

9. Third-party services

The Service displays or relies on data and services provided by third parties (including weather, tide, and government marine data providers). We do not control and are not responsible for the accuracy, availability, or content of third-party data or services. Your use of any third-party service linked from the Service is subject to that party's own terms.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH EXCLUSION IS NOT PERMITTED BY LAW (INCLUDING CONSUMER GUARANTEES UNDER THE AUSTRALIAN CONSUMER LAW, WHICH ARE NOT EXCLUDED BY THESE TERMS).

11. Limitation of liability

To the maximum extent permitted by law, Dropzone Fishing and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of drone equipment, property damage, personal injury, or loss of data, arising from or related to your use of the Service — including reliance on any wind, weather, tide, battery, or seabed information provided. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.

12. Indemnity

You agree to indemnify and hold harmless Dropzone Fishing and its operators from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including any drone incident resulting from your operation of a drone.

13. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you breach these Terms.

14. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. Material changes will be highlighted within the app where practical.

15. Governing law

These Terms are governed by the laws of Western Australia, Australia, without regard to its conflict of law principles. You submit to the non-exclusive jurisdiction of the courts of Western Australia.
